RateON — (Website: https://rateon.io/) — is an online platform for the exchange of digital (electronic) currencies (hereinafter referred to as the Website).
These Terms of Use, as well as any other addenda, appendices, conditions or documents expressly incorporated into this document, constitute the entire agreement between the parties (collectively, the “Terms”). In the event of any conflict between the provisions of these Terms of Use and the provisions of any other addenda, conditions or documents, the provisions of these Terms of Use shall prevail to the extent of such conflict. Any other information presented on the Website, or oral or written statements, is excluded from the scope of these Terms and does not constitute a legal agreement between the parties. The use of the Website and the Services is governed by these Terms.
By accessing, viewing or downloading information from the Website and using the Services provided by the Website, the User confirms that the User has read, reviewed and understood these Terms and unconditionally agrees to comply with them. The Administration reserves the right to amend the Terms at any time without prior notice. The User agrees to continue to comply with any such amended Terms and acknowledges that the Administration is not obliged to notify the User of such changes. The User undertakes to independently review the Terms for any changes.
The User does not acquire any rights to the Website under any circumstances, except for the right to use the Website in accordance with these Terms.
The User is not permitted to access the Website or use the Services if the User is located, registered or otherwise formed in the territory of the following countries, as well as if the User is a citizen or resident of the following countries: Afghanistan, American Samoa, United States Virgin Islands, Guam, Iran, Yemen, Libya, State of Palestine, Puerto Rico, Somalia, Democratic People’s Republic of Korea, Northern Mariana Islands, United States of America, Syria, Russian Federation, Republic of Belarus, Republic of Kazakhstan, Republic of Sudan, Transnistria, temporarily occupied territories of Georgia, Turkish Republic of Northern Cyprus, Western Sahara, Federal Republic of Ambazonia, Kosovo, South Sudan, Canada, United Kingdom, Nicaragua, Trinidad and Tobago, Venezuela, Myanmar, and temporarily occupied territories of Ukraine, as well as any other jurisdictions in which the use of the Services is illegal or requires special licensing (hereinafter referred to as the “Prohibited Jurisdictions”).
The prohibition on the use of the Website by persons associated with the United States of America is absolute and includes any attempts to circumvent restrictions, including the use of VPNs, proxies, nominees or other technical means.
The Administration has the right, at its sole discretion, to monitor compliance with access restrictions to the Services of the Website and to immediately refuse to provide the Services.
Definitions
Applicable Law — means civil and common law, laws, by-laws, conventions, regulations, directives, decisions, orders, court rulings and other binding norms of any governmental or regulatory authorities.
Website / RateON — an online platform for the exchange of digital (electronic) currencies, located at https://rateon.io/, including subdomains, APIs and other means of access.
User — any visitor of the Website who has reached the age of 18 and whose country of residence does not prohibit the use of the Website.
Administration — authorized persons acting on behalf of RateON.
API — application programming interfaces.
Services — means the Website, applications and any services provided by RateON.
1. Access Conditions
When accessing and using the Services, the User is obliged to comply with applicable law, not to engage in activities related to illegal circulation of funds or financing of terrorism, not to distribute illegal materials, not to attempt to undermine the security of the Website, not to disrupt the operation of the service or access of other users, not to obtain unauthorized access to the systems of the Website, not to upload malicious or illegal materials, to ensure the confidentiality of access data and to immediately notify the Administration of any detected security breaches.
The use of the Services may be subject to transaction limits and technical parameters.
By accessing the Website, the User represents and warrants that:
- accepts these Terms;
- has reached the age of 18;
- is the lawful owner of the funds;
- does not violate Applicable Law;
- understands the risks associated with the use of digital assets;
- provides accurate information;
- controls the cryptocurrency addresses used;
- is not associated with Prohibited Jurisdictions;
- is not subject to sanctions and has not violated AML/CFT legislation.
RateON has the right to conduct identity verification of the User. The User undertakes to cooperate with KYC/AML procedures in accordance with AML / KYC.
The Administration has the right to freeze operations if there is suspicion of violation of the Terms or legislation, as well as to block the User’s access to the Services without explanation. The User is responsible for the accuracy of details and instructions. The Website is not liable for losses caused by the suspension of operations.
2. Fees
The use of the Services is subject to fees. The Administration reserves the right to change the amount of fees at any time.
3. Privacy Notice
The procedure for processing personal data is determined by the Privacy Policy of RateON.
4. Representations and Warranties
The User confirms that the User has the right to use the Services, acts on the User’s own behalf or with proper authority, and uses the Website at the User’s own risk.
The User acknowledges that the information on the Website is of a general nature and does not constitute investment advice.
RateON does not provide investment, brokerage, financial advisory or custodial services.
5. Limitation of Liability
RateON shall be liable to the User only for direct damage caused as a result of culpable actions or omissions of RateON in the provision of the Services.
RateON shall not be liable for indirect losses, loss of profit, loss of income, market fluctuations of digital assets, actions of third parties, failures of blockchains, payment systems or communication networks.
The aggregate liability of RateON for any claims of the User shall be limited to the amount of fees actually paid by the User for the last 12 (twelve) months preceding the occurrence of the claims.
The limitations of liability shall not apply in cases of intent, gross negligence, or violations for which liability cannot be limited under applicable law.
6. Settlements
All settlements carried out by the Website are final.
7. Confidentiality
The User undertakes to maintain the confidentiality of information.
8. Force Majeure
The parties shall be released from liability for circumstances of force majeure.
9. Severability
The invalidity of individual provisions shall not affect the remaining provisions of these Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the law of the Republic of Cyprus.
11. Dispute Resolution
All disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Cyprus.
The Administration of RateON has the right to unilaterally amend the terms of the affiliate program.
